1. Definitions

  • “Penzi Flora”, “we”, “us”, “our” – the flower export business operating this website.

  • “You”, “your” – the website visitor, customer, or partner using our services.

3. Product Information and Availability

We aim to provide accurate information on varieties, specifications, and availability of flowers. However:

  • Actual availability may vary depending on season, farm production, and logistics

  • Colours, head sizes, and lengths may vary within acceptable industry tolerances

We reserve the right to revise product offerings, prices, and specifications without prior notice.

4. Orders, Pricing & Payment

  • Orders are subject to confirmation by Penzi Flora and, for exports, are normally governed by separate commercial agreements or proforma invoices.

  • Prices are typically quoted in USD or EUR, excluding freight and any local duties/taxes in the destination country (unless explicitly agreed otherwise).

  • Payment terms will be agreed with each customer and specified in the proforma invoice or contract.

  • We reserve the right to withhold dispatch where payment terms are not met.

5. Shipping, Delivery & Risk

  • For export shipments, we will agree Incoterms (e.g. FOB, CIF) and responsibilities in the commercial agreement.

  • Once goods are handed over to the airline or transporter as per the agreed Incoterms, risk passes to the customer.

  • Arrival times are dependent on flight schedules, airline performance, and customs procedures in the destination country.

6. Quality, Claims & Returns

Due to the perishable nature of flowers:

  • Any quality concerns should be notified promptly on arrival, ideally within [24–48] hours, with supporting photos and quantities affected.

  • We will assess each case and, where appropriate, agree on a fair resolution (e.g. credit on future shipments).

  • Returns are generally not practical for perishable goods, and any return must be agreed in writing in advance.

7. Cancellation

Order cancellation terms will be agreed in the commercial contract or order confirmation. Late cancellations, especially for harvest-ready flowers, may attract charges to cover committed farm and logistics costs.

8. Intellectual Property

All content on this website, including logos, images, text, and designs, is owned by or licensed to Penzi Flora and is protected by intellectual property laws. You may not use our trademarks or content without our prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential losses arising from the use of our website or services.

  • Our total liability in respect of any claim relating to the supply of products shall be limited to the value of the affected goods.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

10. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Kenya. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya (unless otherwise agreed in a written contract).

11. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of the website after changes are posted constitutes your acceptance of the revised Terms.
